ESS Modem will not dial out

I have an ESS ES56CVM-PI internal modem in a Pavilion N5210. Whenever a dialout is attempted a "DELAYED" response is received. What does this mean and how can I fix it.

1) Has the modem ever worked, say in Windows? If so, its a driver problem. If its a winmodem, you'll need to get a driver at http://www.linmodems.com

2) What does the hardware browser say about it?
