hi, i have a ml310e v2 gen8, i have two 4tb hdd, raid 1, debian os, i bought dl380 gen9, if i move the two hdd to the new server, does it work without losing data?

This is going to depend on several factors -- can you please provide some additional details, such as?:

What storage controller are the drives currently connected to in the ML310e Gen8 v2, ie the embedded HPE Dynamic Smart Array B120i controller or an add-in card?
Are you using hardware or software RAID 1?
What storage controller are the drives going to be connected to in the DL380 Gen9, ie the embedded HPE Dynamic Smart Array B140i controller or an add-in card?

NOTE that the embedded HPE Dynamic Smart Array B140i controller in RAID mode is only supported under the UEFI BIOS mode on the DL380 Gen9. Also NOTE that if you plan on migrating from the ML310e's Legacy BIOS mode to UEFI BIOS mode on the DL380 Gen9, there will be additional, somewhat risky, steps required.

Whatever you end up doing, I would recommend making sure your data is backed up before attempting the migration. Just my two cents...

DL380 gen9 should install the P440ar controller, I'm not sure until I get it on Tuesday

I hadn't expected them to use a different bios, what problems does it entail?

Since your existing hardware RAID 1 configuration is using a Smart Array P420, you should be able to move the disks over to the DL380 Gen9 system (with both systems powered off) and the P440ar should automatically pickup the existing configuration. Just be sure to update the firmware on the DL380 Gen9 system before moving the disks over, and again, make sure you have a backup in case things go sideways...

Regarding the BIOS -- I just brought that up in case you were planning to use the embedded Smart Array B140i controller, but since you'll be using a P440ar, you aren't limited to just UEFI BIOS mode. The default BIOS mode setting for Gen9 ProLiant systems is UEFI mode, but it also supports a Legacy BIOS mode. In your case, you would configure your DL380 Gen9 BIOS for Legacy mode if you want to be able to move your disks from the ML310e Gen8 v2 without having to reinstall or restore the software.

I saw that the two disks are now full, I have to buy two more, create a raid 10 on the dl380 and reinstall everything. to do this I need an additional disk where to copy the ml310 files and then copy them back to the new server. finished the work the fifth disc I don't need anymore is it possible to do this with only 4 discs?

today arrived the dl380 g9, B140i integrated smart array, is it compatible with SAS hdd?

Are they showing as full in the Smart Storage Administrator or in Linux?

Smart Storage Administrator will show the drives as full if the space has been fully allocated to partitions at the OS level.

The important question is whether or not the filesystem inside linux is full.

the filesystem has a lot of space, /home is almost full
