my files with the atrib. of the acl

Solution
You can use fbackup. By default fbackup will store the optional ACL entries. You can verify this by reviewing the manual page for fbackup, look at the '-A' option for details. Using '-A' prevents fbackup from keeping the ACL entries.
# fbackup -v -f /dev/rmt/tape_device -i /dir/file
