Does the rules for charging for "new" code apply to kernel modifactions?
I.E. Changing the Kernel code to allow Itanium Processors? ( This may already be part of the Linux Kernel? just an example )

There are many, many, many inaccurate statements that have been made in this thread. For the record:
- HP has made significant contributions for IPF (Itantium Processor Family) code to kernel.org
- Distributions that have released an IPF version include Red Hat, Novell/SUSE and Debian, among others
- HP resells Red Hat Enterprise Linux and SUSE Linux Enterprise Server
- There is no such thing as an "HP Distribution"
