DL380 and NC7781 TCP retransmit and acknowledgement

Hello,
from a network scan we know, that one of our DL380 G3 (NIC 7781, driver version 2.90.0.0, under W2K SP3) sometimes retransmits a packet too early.
For example, the tcp stream has an average rtt of 0.1 sec. If a packet has 0.4 sec rtt, the server retransmits the packet after approximately 0.3 sec.
The packet arrives 0.1 sec later and seems to be ignored. The server retransmits the packet 5 times (although it has arrived, but is ignored), then - as expected - the connection is resetted.
We are wondering if this a known misbehaviour of the used Broadcom 5703 chipset and if it is possible to solve this issue with a firmware and/ or driver update.

Hello,
we know that the drivers are old.

But will the new drivers solve these problem?
Or is these (like the perfmon problem) a standard problem with broadcom chips?

The new drivers are problematic... However, if you set the speed/duplex to 100/Full, you should be okay.

We are trying to get Gig speeds to work.
