Warranty hard drive, what about our data?
I have had a hard drive fail on our server. The drive is under warranty but they want us to send our old drive back and I assume HP will refurbish this and send it out to someone else. Our failed drive has sensitive data on it. What assurances does hp offer that this data will not fall into the wrong hands and will be destroyed?

HP offer a level of warranty on systems that allow you to keep your old drives. It's called DMR "Defective Media Retention" and allows you to keep the faulty media and destroy it. I suggest you take this out on future systems that hold sensitive data.
In this instance, search the web for your local IT Degaussing center (commercial magnet for wiping data).

As said, you can keep the drive and pay a higher price for the replacement drive.
However, I have never seen "refurbish" drives since more than 10 years.
