Patch PHKL_35970 to disable BBR

I have ran the emc grab report on my newly installed server having 11.23 and it reported that u dont have PHKL_35970 which disables BBR.
When I check on my logical volume BBR is off.
In report it is mentioned that there is difference between setting BBr to off and to NONE ( Disable BBR).
So just got confused, shall I install this patch or make BBR off manually everytime whenever will be created.

Any idea ??
